Section 38 street lighting design
A section 38 is the legal term used for a new road which when constructed shall be adopted by the local authority and is the general agreement between a developer and the local authority. Any section 38 is most common place on new estate roads, industrial estates, housing developments and other traffic areas. Once adopted the road and any associated costs will be maintained at the public’s expense, this is most commonly designed by an independent consulting engineer and once constructed would enter a maintenance period for an agreed length of time. This time period can vary, but is often 12 months. After the agreed maintenance period has been completed the new estate road would become adopted and all responsibility passed to the local authority from the developer.

Section 278 street lighting design
A section 278 is the legal term for an agreement between a developer and the local authority/highways agency when existing roads are effected by a development. The section 278 agreement is entered between the developer and the local authority to ensure that any alterations to the existing carriageway. It is essential that this agreement is entered into the ensure that the access road or alterations are in accordance with the local authorities current specifications. Any new works should be carried out in accordance with current guidance documents for highway works with reference to drainage, traffic signs, site clearance, earth works, carriageway design and the street lighting improvements (to name but a few).
A section 278 is the legal agreement which comes under the Highways Act 1980.
